Parete Lawsuit

Below is the John Parete lawsuit over redistricting. This is a good lawsuit that is designed to help make sure that the legislature does not am mend or change the lines after the commission is done drawing the lines..basically John Parete, a former Democratic Elections Commissioner is making sure that the redistricting is done impartial as stated in the charter.

When it comes to reapportionment the charter is a little vague, which is one of the reasons for the suit, Parete is asking for a Judge to offer his/her opinion on the matter. Pay close attention to paragraphs 12-16.

Sorry Mr. Parete & Mr. Kadgen you don't have standing to bring this claim. As a result, the proper remedy here is that your lawsuit should be thrown out.

They have standing, they are citizens that will be affected by the resultant districts. Anything anyone can do to keep that dishonest, backstabber Wadnola away from the process, the better.

Would they be doing this if they had the majority. As the suite states... " the selling point of the Charter revision was to keep politics out of this process". Follow your own Charter revision and "keep politics" and LAWSUITS out of the process.

Actually their lawsuit makes perfect sense. The legislature has obviously bungled this process, and behind the scenes have been trying to figure out how to nominate candidates for the upcoming elections because the new redistricting information won't be out in time. Members are mainly Marlboro and Ulster/Saugerties (what a suprise) Maybe this Committee should have been put together six months earlier.

If nothing changes, the Legislature will be hacking up the districts to suit their needs. Not just the Republicans. They will take care of their Democratic friends too. One hand washes the other.

The only way to make sure the districts are fair is to keep the meddling Legislators out of the mix.

By the way, this will also keep the Executive from interfering too!

Goverment sucks!!!! after the county we will have the assembly and senate, and congress gerrymandering seats. Till this all changes we are screwed. Just keep paying the bill. Thats why New York loses population people leave to be able to live

Good for Parete. The charter calls for a citizen commission to determine the legislative districts. The legislature is not empowered to amend their decision. What is in dispute is whether the legislature has to vote on it. If it does it would be an up or down vote with the county exec. having veto power. I believe that the spirit of the charter agrees with Parete's positon.

Lets' have 23 districts that spoke like a wheel from the city of Kingston where we can get at least 1.5 to 1 Democratic enrollment advantage in every district so we can have 23-0 Legislatures from now on. Oh, life is blissful, Can I get on the redistricting commission?

Where was Parete when the charter was being revised? Did he argue these points then? Though the commission could've been selected earlier, they still could not have gotten started until the census was completed. Everyone knew this - why a lawsuit now? The reapportionment commission has no legal standing to pass policy - only the legislature can. The question is, is it an up or down vote or can they revise the commission's findings? This should have been addressed in the charter.
